The Lithuanian Free Market Institute has examined draft amendments to Articles 3, 4, 6, 7, 14, 16, 19, 20, 24, 27, 28, 29, 30 and 51 of the Law on Local Self-Governance aimed at expanding the list of exclusive competences of municipal councils by introducing a periodic assessment of the need for and relevance of municipal enterprises and submitted its comments and proposals to legislative bodies and other stakeholders. In its position note LFMI has upheld the draft amendments and proposed that:
- the assessment of the need for municipal enterprises relies on universally established principles;
- the assessment procedures are based on currently applicable criteria;
- the assessment procedure is carried out every three (as opposed to four) years;
- articles of association of municipal enterprises are made publicly available.
