LFMI on proposals to compensate for competition violations by public administration

Lithuanian Free Market Institute has analyzed draft legislation No. 16–1510 of the Lithuanian Competition Act no. VIII–1099

LFMI suggests that the new EP and EC directive 2014/104/EU regulations should also be applicable if a person suffers damages due to public governmental body’s actions which violate the Lithuanian Competition Act Article 4.

Aforementioned persons should be allowed to bring action towards such governmental bodies for damages because:

  • it would fulfill the purpose of the Directive;
  • Competition Act violations of the governmental bodies make up a significant portion of all Competition Act violations in Lithuania;
  • consumers experience significant damages due to violations committed by governmental bodies;
  • such amendment would ensure equality before the law.
