Government Watch. Position paper on amending the Law on Right to Receive Information from State and Municipal Institutions

The Lithuanian Free Market Institute (LFMI) has examined draft amendments to the Law on Right to Receive Information from State and Municipal Institutions and submitted its comments and proposals to relevant legislative bodies.

In its position paper LFMI noted that Article 2(2)(1) of the draft law stipulate cases when the requirements to provide information are not applicable to state and municipal institutions. Under Article 2(2)(1), institutions may not provide information in cases when “under legal or regulatory provisions, providing information is not a public function of the authority, except for the information on wages”. In LFMI’s view, this exception implies unjustified restrictions on the society to receive information from public authorities that are responsible for managing and have information at their disposal. Therefore, LFMI calls for upholding Article 2(2)(1) of the current law.
